Terms of Service

These Terms of Service ("Terms") govern your use of the Wild Above website at wildabove.ca and your engagement of Wild Above's drone photography and videography services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our website or engaging our services. If you do not agree to these Terms, please do not use our website or services.

Our Services

Service Delivery

Wild Above provides professional drone photography and videography services as agreed upon in individual project contracts or quotes. The scope, deliverables, timeline, and pricing of each project will be outlined in a written agreement or confirmed quote prior to commencement of work.

Weather and Scheduling

Drone operations are subject to weather conditions and Transport Canada regulations. Wild Above reserves the right to reschedule shoots due to unsafe weather conditions, restricted airspace, or other circumstances beyond our control. No additional charges will apply for rescheduling due to weather.

Client Responsibilities

Clients are responsible for:

  • Obtaining any necessary property owner permissions for shoots on private land
  • Providing accurate project information including location, requirements, and timeline
  • Being available for communication on shoot day
  • Timely payment as per agreed terms

Revisions

Each project includes one round of revisions to delivered content. Additional revision rounds may be arranged at an agreed additional cost. Revision requests must be submitted within 14 days of initial delivery.

Payment Terms

Payment terms will be outlined in your project quote or contract. Generally:

  • A deposit may be required to confirm booking for larger projects
  • Final payment is due upon delivery of completed files
  • All prices are in Canadian dollars (CAD) unless otherwise specified
  • Applicable taxes will be added where required by law

Wild Above reserves the right to withhold final deliverables until payment is received in full. Late payments may be subject to interest charges as permitted by applicable law.

Cancellations

Cancellations made with less than 48 hours notice prior to a confirmed shoot date may be subject to a cancellation fee as outlined in your project agreement. Cancellations due to weather or circumstances beyond the client's control will not incur cancellation fees.

Intellectual Property

Ownership of Content

Wild Above retains copyright ownership of all aerial footage, photographs, and edited content created during service engagements. Upon receipt of full payment, clients receive a non-exclusive license to use the delivered content for the purposes outlined in their project agreement.

Permitted Use

Delivered content may be used for the client's marketing, advertising, social media, website, and print purposes as agreed. Clients may not resell, sublicense, or transfer content to third parties without prior written consent from Wild Above.

Full Copyright Transfer

Full copyright transfer or exclusive licensing arrangements are available and must be negotiated and agreed upon in writing prior to the shoot. Additional fees apply for full copyright transfer.

Wild Above Portfolio Use

Wild Above reserves the right to use delivered content in our portfolio, website, and marketing materials unless the client requests otherwise in writing prior to the shoot.

Website Content

All content on the Wild Above website including text, design, graphics, and imagery is the property of Wild Above and may not be reproduced without written permission.

Limitation of Liability

Wild Above operates all drone flights in full compliance with Transport Canada regulations and carries commercial liability insurance. However, to the maximum extent permitted by applicable law:

  • Wild Above shall not be liable for indirect, incidental, or consequential damages arising from the use of our services
  • Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim
  • Wild Above is not responsible for delays or failures caused by circumstances beyond our reasonable control, including weather, equipment failure, or regulatory restrictions

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.

Governing Law

These Terms of Service and any disputes arising from your use of our website or services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Ontario.

Changes to These Terms

Wild Above reserves the right to update these Terms of Service and Privacy Policy at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
